Overview

Part of the job of the Risk Management Department of your professional indemnity carrier is to work with the company’s claims reviewers to identify current trends in the allegations made by plaintiffs against their insured doctors, identify “hot spots” of excessive or unusual claims activity, then address them with educational tools designed to inform doctors of the emerging liability issues and what they should be doing to avoid becoming targets of such allegations. themselves. Three liability topics of current concern are: negligent violations of the HIPAA Privacy Rule; liability risks created by using electronic health records, and sexual harassment and professional boundaries in the #MeToo era.

Objectives

 

Upon completion of this course, a physician should be able to:

1.  Explain common errors that lead to negligent HIPAA violations and steps you can take to avoid them .
2.  Discuss the legal implications of sexual harassment and other forms of discrimination.
3.  Discuss the liability risks created by electronic health records and how to avoid them.

This course is appropriate for all orthopaedists.

Methodology

 

This is a self-study course consisting of text and CME test.  Physicians should read the course content, answer the test questions and submit the answers for scoring.  Those who complete the course with a score of 80 percent or higher will earn a maximum of 6 AMA PRA Category 1 creditsTM.
